Terms and Agreements
ACCEPTANCE AND AGREEMENT
I hereby agree to accept and abide by the terms of this Membership Application and Agreement. I understand that this membership agreement is for a term of twelve (12) months and will continue thereafter on a month-to-month basis unless cancelled by me
I hereby authorise Train N Tone PTY LTD to effect payment for monthly dues and approved Membership charges for the duration of my membership through electronic funds transfer. This authorisation is to remain in full effect until Train N Tone PTY LTD has received WRITTEN NOTIFICATION from me on cancellation in writing by letter and I understand I must provide THIRTY DAYS' NOTICE of any cancellation.
MEMBERS’ HEALTH WARRANTY
The Member warrants and represents that the Member entitled to use the facilities of Train N Tone PTY LTD under the terms of membership, has no pre-existing disability, impairment, or ailment preventing her from engaging in active or passive exercise, or that will be detrimental or averse to such person’s health, safety, or physical condition if she does so engage or participate. The Member acknowledges and agrees that:
1) Train N Tone PTY LTD will rely on the foregoing warranty in issuing the Membership;
2) Train N Tone PTY LTD shall have no obligation to perform a fitness assessment or
similar testing to determine the Member’s physical condition;
3) if any fitness assessment or similar testing is performed by Train N Tone PTY LTD, it is
solely for the purpose of providing comparative data with which the Member can track progress in a program and is not for diagnostic purposes.
4) Train N Tone PTY LTD shall not be subject to any claim, demand, or injury whatsoever on account of Train N Tone PTY LTD’s evaluation or interpretation of such
fitness assessment or similar testing.
5) Train N Tone PTY LTD shall not be liable for any injury arising out of the Member’s disability impairment or ailment preventing her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if she does so engage or participate. Each Member should be aware of her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition appears or appears to be developing.
LIABILITY AND WAIVER OF LIABILITY
Each member of Train N Tone PTY LTD shall be liable for any property damage and/or personal injury (caused by the Member or any other person) at Train N Tone PTY LTD’s premises or any activity or function operated, arranged or sponsored by Train N Tone PTY LTD. It shall be the obligation of the member to pay for any costs involved upon presentation of a statement thereof. Any and all use of the Train N Tone PTY LTD Facilities, or participation in, Train N Tone PTY LTD activities operated, arranged or sponsored by Train N Tone PTY LTD either on or off of the Train N Tone PTY LTD’s premises by the Member, Member’s Family or Guest(s) shall be AT SUCH PERSON’S OWN RISK, and Train N Tone PTY LTD shall not be liable for any injuries or damages to such person, or the property of a such person, or be subject to any claim, demand, injury or damages. The Member individually, and on behalf of the Member’s personal representative, heirs, administrators, assigns and successors do hereby expressly forever release and discharge Train N Tone PTY LTD, its successors and assign, as well as its officers, agents and employees from all such claims, demands, actions, or causes of action.
PLACING MEMBERSHIP ON HOLD
Membership may be placed on hold for a minimum period of one (1) month. Requests for placing membership on hold must be in writing and delivered to Train N Tone PTY LTD person.
SUSPENSION/TERMINATION OF MEMBERSHIP BY MANAGEMENT
Management has the right to suspend and/or terminate any Membership for non-payment of dues, fees, Train N Tone PTY LTD property damage, or for behaviour detrimental to the enjoyment of Train N Tone PTY LTD by other members and staff for any reason deemed sufficient in the sole discretion of Management.
MEMBER’S RIGHT TO CANCEL OR TERMINATE
Members have the right to cancel this contract within three (3) business days. Cancellation must be in writing and delivered to Train N Tone PTY LTD in person. Dues for the final month will be prorated and billed during the final month. Month-to-month members may voluntarily terminate membership at any time after their 12-month agreement for any reason by:
1) notifying Train N Tone PTY LTD in writing in person 30 days prior to cancellation
2) paying all current charges prior to termination. You may also cancel if the Member relocates more than 20 kilometres from the Train N Tone PTY LTD studio and provides adequate proof of residence.
UNPAID BALANCES
Management reserves the right to undertake the following steps should any members’ balance be 30 days past due
1. Collect the current and past-due balance.
2. Suspend and/or terminate membership privileges.
3. Collect a service fee of $30.00 for any cheque payable to Train N Tone PTY LTD which is not honoured.
SCHEDULE OF FEES
Should you wish to exit your Contract prior to its expiration, full payment to the term of the Contract will be required. Written notice to Train N Tone Management is required.
FILMING AND PROMOTIONAL MATERIAL
Train N Tone PTY LTD reserves the right to film clients. Through hereby agreeing to these terms and conditions, Train N Tone PTY LTD reserves the right to use any images for all social media and promotional materials. Should you wish not to be filmed a written declaration must be made to Train N Tone management.
ENTIRE AGREEMENT
This agreement constitutes the entire and exclusive Membership Agreement between the parties. Any promise, representation, understanding,
oral or written, pertaining directly or indirectly to the Agreement which is not continued herein, are hereby waived.
